yesterday i learned...

...what "prima facie" means. i have basically had a working definition of it for years now. in my world it means when a DHS client doesn't show up for a trial-either to establish their child as a ward of the court, or to terminate their parental rights-and the state goes ahead and presents evidence anyway and an order is made without the client having a chance to argue his/her side. but i had to do one of those yesterday and it always makes me feel weird, like the state is playing God or at least Big Brother, so i actually looked it up on wikipedia. this is what it said:

"In most legal proceedings, one of the parties has the burden of proof, which requires that party to present prima facie evidence of all facts essential to its case. If that party fails to present prima facie evidence on any required element of its case, its claim may be dismissed without any response by the opposing party. A prima facie case may be insufficient to enable a party to prevail if the opposing party introduces contradictory evidence or asserts an affirmative defense. Sometimes the introduction of prima facie evidence is informally called making a case or building a case.
For example, in a criminal prosecution, the prosecution has the burden of presenting prima facie evidence of each element of the crime charged. In a murder case, this would include evidence that the defendant's act caused the victim's death, and evidence that the defendant acted with malice aforethought. If the prosecution were to fail to introduce such evidence, then its case would fail on grounds of "failure to make out a prima facie case," even without rebuttal by the defendant. This evidence need not be conclusive or irrefutable, and evidence rebutting the case may not be considered."

you learn something new every day.

and today i learned that those gel heel protectors--you know, the ones you stick to the heel of your shoe to help them fit more snugly and not cause blisters--don't work. a) they are nearly impossible to peel from their backing, and b) they just roll up and make your heels sticky and finally end up in a little silicone wad.

i also learned that if you have shoes that you really love but are half a size too big, you can shove rolled up latex gloves in the toe. they don't get sticky, and they don't make your toes sweat. and they keep your heels from coming out of your shoes when you walk.

two unrelated pumpkins and an also unrelated dorky dog

i am a little buzzy on my favorite trader joe's red wine (washington hills shiraz, in case anyone wants to know). i have been going through some rough times lately, so i haven't been blogging. but i'm starting to feel better and starting to miss writing to my friends and whatever random internet surfers are reading this blog. i don't have anything profound or even coherent to say this time, but oh well. you'll surf away from this page if it sucks too bad.

1. on the worst of the suckiest days of the recent sucky days, matt and i went to a new place here in eugene called agate alley, hoping a new and interesting place might cheer us up or at least distract us. it worked, because i discovered my absolute favorite martini ever. if you know me, you know i do say things LIKE that lightly, but let me assure you, i never say exactly that lightly. i have been loyal to my previous "absolute favorite martini ever" since 2002, when i discovered the "ad lib", a cilantro martini served at 820 in north portland. i almost feel like i'm cheating on the ad lib by writing this. but this martini is incredible. it is pumpkin pie in a glass. it is the "pumpkin martini," made with vanilla stoli, pumpkin (real pumpkin!), cream, cinnamon, and nutmeg, with a sugar and graham cracker rim. if you live in eugene or plan to be anywhere near here sometime this fall, i HIGHLY suggest you get yourself to agate alley (and bring me with you!) to try this martini. here it is:



2. matt, troy, ashley, myself, and some other ninkasi folks went up to corvallis on saturday for the "septembeerfest" at the fairgrounds. we brought our ipa and a fresh hop beer that was specially brewed for this fall's beer festivals. (brewing "secret": it has MILLET in it! yum!) it will be on tap in the ninkasi parking lot at the fresh hop fest on the 25th. but that's not the story. the story is that next door to our booth was a booth where instead of kegs, the beer was being served from GIANT PUMPKINS! look at this...




3. the other day when i was at work feeling a little sad, matt took this picture of otis and sent it to me on my phone:


look how cute and dorky he is with his tongue hanging out! :) matt is wonderful that way. he knows i'm a sucker for the dog, especially when he's sleeping. and he knows getting picture messages makes me happy. if i didn't have him to go through all this crap with, i don't know what i'd do (but it would probably involve a lot more pleasurable yet self-destructive behavior, and a lot more feeling sorry for myself). but you know what? even with the shit i'm going through lately, i really do have it pretty good.

weird polo shirt guy

i rode my bike up to petco ("where the pets go!") tonight to get some stuff for otis. when i came out, there was this tallish, medium build, average-looking guy with glasses standing by the bike racks. he had on khaki dockers and a red polo shirt--like he worked at target, but there was no target anywhere near by. he was smoking, and kind of staring at me. i acted like i didn't notice him. he said "mumble mumble mumble mumble, huh?"
i looked up.
he said "getting some shopping done, huh?"
"yeah," i said.
a longer-than-usual-conversational-pause later, he said "is that for a cat or something?"
"dog."
"oh." (another longish pause) "it's just that single gals usually have cats."
"huh," i stated non-committally, and reached up to unlock my bike, positioning my left hand so that it was in plain view.
"so...last year greenhill did this thing where pets and their single owners could go listen to music and drink wine."
"yeah?" as i put my helmet on with exaggerated left-hand posturing.
"i have a dog," he started in,"what dog park do you go to? actually i don't really have a dog, i borrow one from my neighbor. she lets me borrow it because dogs are good for attracting women. but it likes the dog park..."
borrowing a line from miranda on sex and the city in the episode where she has a bad date in central park with this guy who refuses to go anywhere other than manhattan, i got on my bike and said "i have to go feed my cat."

frikkin frustrating stupid computer stuff

can anyone please help me? i'm trying to make my blog prettier. i don't really like any of the templates blogspot gives me to choose from (which is why i keep changing my template. i mean, i LOVE my myspace template, and i've never changed it once!). i have wasted too much work time this morning cutting and pasting html from free template download sites, and it has not worked yet.

pokey

pokey is this cute little virtual yellow lab puppy you can adopt on facebook. he looks just like a real puppy. he has all the mannerisms and facial expressions. he bounces around and wags his tail when you are about to feed him. he rolls over and exudes puppy happiness when you scratch his belly. he bounds after a virtual frisbee (much more enthusiastically than my real dog!) and comes running back so proud of himself when he catches it. he lays down and looks sad but patient when you're about to "leave" him. when you haven't "fed" him for a few days he looks tired and dehydrated when you click open the program. and his eyes have that combination of sadness, hope, and pure puppy gratefulness that you haven't actually abandoned him. whoever created this program is twisted! all it does is create guilt! when i play with him too much, i feel guilty for goofing off at work. when i don't play with him enough, i feel like a bad mama! as if it were really otis giving me that "why-haven't-you-fed-me-in-15-days-but-thank-god-you're-back-i-love-you" look. it's terrible! and worse still, you get roped in to taking care of other people's virtual dogs. if a dog has been neglected for however many days, they go on a list. you can feed them with your own dog's virtual dog food, which will earn you bones (the currency to buy more dog food and toys and stuff) and make you feel like somehow you have done something good. but you really haven't!! it's not a real dog!!! someone must be tracking this somewhere, like some psychological experiment on the capacity of a simple computer program to manipulate human emotions. i almost want to delete pokey, but then i will feel as if i've put my dog to sleep! this is sick.

grandma jean

as some of you know, my grandma jean passed away last month. she had a stroke in january, but she came out of it mostly ok and went home (where she has had caregivers staying with her for the last several years). my dad went down to southern california (where she lived) immediately. the family made sure that all of us cousins/grandkids were in town for her 94th birthday weekend in march. i was not sure if i could go or not--because we were moving and busy and i didn't think i could afford it--but my wise husband told me that it might be the last time i'd get to see her and he didn't want me to miss that opportunity. i ended up going, and i'm very grateful that i did, because a week and a half later, she passed away. she went peacefully, and my uncle tim was there when it happened. matt came down with me that weekend for the funeral, and he was wonderful (unlike a certain nameless "dude" who ran and hid last time someone close to me passed away!).

my grandma jean was an amazing lady. i don't want to go on and on here in the blog, but i'll just say that she has been an inspiration to me. she was the kind of person who made you feel good about yourself (even when correcting your grammar, or telling you to comb your hair and not to eat too many rolls at dinner), and who made you feel good about everyone else, too. she LOVED life, and lived it fully. she always saw the positive side of a situation, and she found joy easily. she had incredible style and and endless supply of love to give. she was always surrounded by family and friends who loved her.

big day

yesterday was a big day. the biggest thing for me was closing on the house that we bought. it's officially ours now, and we get the keys on monday. signing for it took much longer than i remembered it taking last time i bought a house. and they wouldn't just let us sign our usual signatures--they made us sign our ENTIRE names on each of the hundred or so lines on which we were required to sign. there was even a page where we had to sign our names every possible way we could (marissa beatty, marissa j beatty, marissa jean beatty, m.j. beatty, etc.). for me this was even longer, because it made me go through the whole thing with "macdonald," too. and, weirdly enough, there was one line where i was "marissa c beatty." i pointed out that my middle name has never started with a c, and the lady told me to just cross out the c, write "never known with a c," and sign "marissa beatty." i'm surprised they didn't take our fingerprints and scan our retinas.

the second big thing was that ninkasi went into bottles--to be sold at the actual grocery store! (j, i know. i can't just make up punctuation rules whenever i want like an exclamation point in the middle of a sentence, but i'm doing it anyway)--for the first time yesterday. this dude called the "mobile bottler" came down from washington with his machine (also called the "mobile bottler"), unfolded it like a transformer, hooked it up to the tanks, loaded bottles into it, and voila! ninkasi in bottles! i stood around the brewery (because i took the second half of the day off, knowing i wouldn't be able to sign for a house at 1:00 and then contain my excitement enough to go back to work) drinking beer and taking pictures of the process. i switched my (old, outdated, and with annoying delay) digital camera to the "black and white" setting, and i actually have a pretty good little ninkasi bottling slideshow that i was going to put up here. but alas, after all the excitement, everyone went out to the bier stein to celebrate and i left the camera there. oops.

scrabtastic!

i have recently signed up for facebook. i don't really get it, but a lot of my friends are starting to defect to it from myspace. it seems a lot more complicated than myspace, and also a little more annoying (people poke you, feed you turkey, throw shit at you, etc). but the one redeeming factor that might get me to switch over all together is SCRABULOUS! it's a feature you can add on facebook where you can play scrabble with people! myspace doesn't have anything like that!

right now i'm at home working on an LAR (DHS people know what that is, for non-DHS folks it's a ridiculously long document that you create by basically going through an entire case file and re-writing everything in it onto a form that the department of justice uses in trial to help you terminate someone's parental rights. it takes about a million years to finish), and i'm obsessively playing online scrabble with strangers to distract myself from the fact that it's 9:30 and i really just want to be drinking wine and watching tv.

a little update on the house buying

the seller accepted our counter-offer, and we're in the inspection process. the sewer scope inspection is scheduled for this afternoon. (when i sold the house in portland, the buyers asked for a sewer scope and i guess it turned out that our sewer was shot to hell and just days away from having serious problems, so we had to spend thousands of dollars to fix it in order to still sell the house.) the house was built in 1925, but there was a fire in 1999 and the flooring, roof, windows, and all electrical are pretty new. it's really cute, and has a porch swing! here's a picture:

bloggin' again

i have definitely been slacking off in the blog department, and it has prompted at least one person to call and make sure i'm ok. i am. i'm just not feeling the writing these days. right now i'm sitting on my couch (actually the futon) with gracie and otis, watching "biggest loser" and the snow falling outside. matt's at work brewing delicious oatis otmeal stout. we went to missouri last weekend to see matt's family and eat more meat, mayo, and american "cheese" than anyone ever should. but probably the biggest news is that we have put an offer down on a house. twice, actually. we put in a full-price offer the day it went on the market (there were a TON of realtors and potential buyers swarming it when we went to see it). it was rejected because we are buying with a VA loan (matt was in the navy for a few years after college) and i guess people don't like VA loans. but the second buyer mysteriously disappeared and the seller's agent came back on us and asked if we were still interested. so we offered a little lower (hey, you would too) and were counter-offered. we counter-offered again and are waiting to here. the place is cute: 3 bedrooms, 1 bath, fenced back yard for the doggy, and a block from the brewery in the whiteaker neighborhood, which has all the signs of an early alberta street or mississippi in portland (there's even an art walk every last friday). i'll keep you posted... :)

nutria motel

apparently the nutria are coming into the house now. and they're attacking my cat! gracie has been hiding a lot lately--in cupboards and under things--and the other day she had a wound on her neck. we cleaned it up and made sure she was current on her rabies shots. and then last night (i missed all of this somehow, by the way, because apparently i sleep like i'm in a coma) otis woke matt up at 2 am barking and running back and forth next to the bedroom door (he sleeps in the bedroom with us with the door shut so he can't dig through the trash in the middle of the night while we're sleeping). so matt went out into the living room to see what was up and otis started howling and looking around. grace was practically behind the refrigerator. nothing else was out there, though, so he went back to bed. the same thing happened at 2:30. then at 3, gracie woke him up by scratching on the bedroom door. he went out again to make sure nothing was going on and saw ratty tail disappear out the cat door. he shut the cat door. then he was woken up again at 4 by the nutria, scratching alternately on the cat door and the bedroom window, like he was asking to be let in! fantastic. a nutria with a sense of entitlement.

improvements?

i had some helpful feedback the other day that the black screen made it hard to read my blog. i also had the feedback that having it all on one site (i.e. my myspace) would be an improvement. i was all ready to move my blog to my myspace to keep everything consolidated and save people's time (and mine) flipping through pages online, but then i realized that some of my friends/family who read this blog don't have myspace, and wouldn't be able to get to the blog without signing up (and for whatever reason they won't or don't). so i'm keeping the blog here for the time being at least. but i tweaked the font a little and made it bigger and differently-shaped, so i want to know, is it still hard to read this way or does this work?

interesting book

i just started reading a really interesting book. last friday, on our way back to eugene from thanksgiving dinner (and delicious thanksgiving-leftovers brunch the next morning) at my auntie's, matt and i stopped at powell's and this book was one of the recommended reads. it's called "better off," by eric brende. it's a non-fiction account of when he and his wife (who, interestingly enough, he married immediately before this experiment) went to go live with an amish community for 18 months to learn what it is like to exist without using fuel or electricity. the author is really wordy, and uses a lot of "big" words awkwardly, and his sentences are kind of hard to follow, but what he has to say is intriguing enough to make it hard to put down. i'm only two chapters in but i'll keep you posted. (unless i move in with the amish and quit using my laptop. just kidding. but seriously, it's tempting. but i don't think there are any amish around here. are there?)

what ever you do, do not buy...

...three-buck chuck's new wine. i like the chuck, generally, especially the shiraz. out of the 2-5 bottles of trader joe's wine that make their way into my shopping cart every 2-3 weeks, a couple bottles of chuck are regulars. i was at trader joe's the other day and was lured to the charles shaw display by bottles saying "nouveau." i don't speak french at all (as b knows from when we were in france together), but i assumed that meant this was a new one. i picked up a bottle and saw that it was a "valdiguie" (pronounced "val-de-gay," i later found out). i had no idea what that was but i put it in my basket anyway. yay! a new chuck! i googled (actually blackled) it--not chuck specifically, but valdiguies in general, just to find out what they were--tonight, and all i found was trader joe's on blast all over the internet for this nasty, nasty wine. "no way, these are just snooty wine snobs," i thought, as i opened up my lovely new chuck and poured myself a glass. i put the goblet up to my nose, took a breath, and smelled...grape juice? raspberry cider? what the hell?! then i tasted it, and it's GROSS!!!!!!

black and green

i signed up for this green email tip of the day site (www.idealbite.com) and the other day it told me about www.blackle.com, which is google, but with a black screen. and not all the other cool stuff like maps, images, etc. it's pretty basic. but it's point is that a black monitor screen uses significantly less energy/fuel than a white screen. and when you go on blackle, it says how much energy has been saved to date by people using blackle instead of google as their home page, search engine of choice, etc. i also (as you i'm sure have noticed) changed my blog layout to be all black, and since i waste so much time on there i'm about to go see if there's a black myspace layout i like. it may seem like last minute and too small, but any steps we can take i believe are important...

ch ch ch changes

yeah, i know i stole that title from jenn's blog.

changing my name is much weirder than i though it would be. having gotten married in the 21st century, it was completely my choice to do it. i asked matt what he thought and he wouldn't give an opinion one way or the other; he said that it is an individual decision. i want my future possible kids to have the same name as their mom and their dad. and i want to have the same name as my life partner.

it took me a while to do it after the wedding because i had plane tickets to denver in my old name and i figured they probably wouldn't let me on the plane if my ticket said macdonald and my license said beatty. now that i've been back for a month, i'm almost completely switched over. the first thing i had to do was get my marriage license. then i used that to change my drivers license and social security card, both of which were mailed to me a few weeks later rather than given to me on the spot. so i had to run around with a paper version of my new drivers license (they wouldn't let me keep the old one temporarily), which was kind of crappy because apparently you can't get a library card or a margarita with a paper drivers license. i'm also kind of annoyed because i just had gotten a renewal license in may and my photo was so cute! i mean, i looked good! you'd think that with their huge state-wide database, they could save people's pictures for however long just in case people lose their license or, say, change their name, but no. so my new picture just looks blah. i look kind of plain-jane, and suburban (which i'm not) and wife-y. and i don't even know what i mean by that because i'm having all kinds of strange emotions and ideas about wife-y-ness floating up from who knows where into my head. i mean, nothing has changed between me and matt since we got married other than the legal, but all of a sudden i'm feeling aware of all these archetypes and connotations and stuff. and i feel like i have to sort out what my definition of being a wife is from that of society, or past society, or other people, or tv, or whatever else. i mean, is it a description? a label? an honor? a relationship? a role? what kind? i think i might be confusing matt with all this. he says i'm exactly the same person i was the second before we got married, and he just wants me to be myself. and he's right, but where is all this other stuff coming from?

so then i had to use my new license to switch stuff over at my bank and at work, all of which have taken much longer than the last two things, so i've been in this weird name-limbo for a month. i say beatty for some things and macdonald for others, and i sign beatty on everything except for my debit card transactions because they haven't sent me my new card yet. just today they figured it out at work and i couldn't get into my computer because my log-in was changed (and, frustratingly, i could only open the email explaining how to log in with my new name once i'd logged in with my new name). and the voicemail greeting i left today was that my name changed so from now on this will be marissa beatty's voicemail. it feels so optional what my name is all of a sudden. like dying my hair. like i could wake up tomorrow and decide that i want to be called sarah jones and tell everyone that's what they have to call me from now on. and i have this amnesic feeling that i'm going to forget my name. which is kind of like forgetting who you are, right? but then again not really...it brings up the whole "a rose by any other name" thing.

anyway, it's provoked a lot more thought and feeling than i thought would happen, for sure. i do like my new name. it feels very english. and easier to say after my first name. it flows better. and of course i love the man that "gave" it to me from a bottomless well. so that helps.

hip hop dance class!

i just discovered the funnest (i know that's not a word) thing ever (and i know i'm speaking in hyperbole): hip hop dance class!! i definitely felt like an oaf-ish white girl, but it is so worth it. i put on hip hop and dance around my living room--a little less oafishly, i would like to think--all the time anyway, i might as well learn how to do it right. and the girl who teaches the class is really good. for anyone in town who wants to come with me, it's at 6:30 on monday nights at oakway fitness. (and ib, if you're reading this--if you were in town i would so try to get you to come with me! remember when we used to dance to old school hip hop like mc hammer and stuff? :) those were good times!)

hermity

hey, i know i just blogged yesterday, but i am having such a glorious hermit-y weekend that i have to talk about it. i forgot how much i liked just hanging out by myself in my pajamas. right now i'm on the couch in matt's bathrobe watching "knocked up." matt and troy decided to stay at the coast one more day, so last night i made another mini "test pizza," lit all the candles in the living room, drank half a bottle of wine, watched football, and downloaded mtv mash-ups on limewire. nelly vs. lynyrd skynyrd. brilliant! sitting around doing exactly what i want and nothing i don't. all by myself. when you're living with someone, it's easy to forget how soothing it is, and and how important it is to do every now and then.
